To place an advertisement on Escort Platinum, the Agency must agree to the following terms, representations, warranties, and covenants:

Representations, Warranties, and Indemnity
The Agency represents, warrants, and indemnifies Escort Platinum as follows:

• That the person or persons portrayed in the photos was over the age of eighteen (18) years at the time the photos were produced;
• That all photos submitted to us by the Agency have been produced in accordance with all applicable provisions of the Child Protection Restoration and Penalties Enhancement Act of 1990;
• That all activities in connection with the services that the Agency provides are within the requirements of the laws of the United States of America, and those of any state, municipality, country, or province in which the Agency operates;
• That any photos submitted to Escort Platinum by the Agency may be modified, displayed, and used free of charge for the purpose of adult Internet advertisement;
• That the Agency understands that the photos submitted to us are to be used for adult Internet advertising;
• That the Agency owns or controls the rights to the photos;
• That the photos are wholly original and have not been copied in whole or in part from any other work, picture, or source;
• That the photos are neither fake nor "stock" photography;
• That the photos do not infringe the copyrights or violate the rights of any other work, person, film, corporation, or entity whatsoever;
• The Agency hereby indemnifies, defends, and holds Escort Platinum and its officers, directors, owners, agents, information providers, affiliates, licensors and licensees harmless from any losses, damages, costs, charges, reasonable attorney's fees, recoveries, actions, judgments, penalties, expenses, and other losses whatsoever in connection with any claim arising out of any breach or misrepresentation by the Agency of these terms or the foregoing representations, warranties, and covenants;

Miscellaneous

• Any dispute or claim arising under or with respect to this Agreement which is incapable of resolution will be resolved by arbitration before one (1) arbitrator in Los Angeles, California in accordance with the Rules for Commercial Arbitration of the American Arbitration Association ["AAA"]. The appointing agency shall be the AAA. The decision or award of the arbitrator shall be final and binding upon the parties. Any arbitral award may be entered as a judgment or order in any court of competent jurisdiction. The laws of the State of California shall govern the interpretation, validity, and enforcement of this Agreement.

By entering and submitting the Agency Owner's/Representative's Legal Name below, the Agency hereby agrees to the terms, representations, warranties, and covenants as listed above.
